Depends on what the application form says. If it requires that you disclose all education and you don't, and then sign your application, then you've committed fraud. You have lied. When you sign something, it's a contract, and you are making certain promises. If they find out later, it could be grounds for academic probation or revoking your acceptance.
That said, your college cannot release your transcripts without your permission. However, your new college is going to wonder where your transcript is and why you won't share.
Running away and hiding things never solves the problem. Best to disclose and write a great essay explaining what happened and why things have changed. Many community colleges accept people who had a hard time before. Sorry, but the answer is no. In the USA all accredited colleges require prospective students to submit transcripts from all colleges where they have been enrolled even if no work was completed. If you do not submit all transcripts and get caught, you will be expelled from college and may be fired from a job if it takes that long for the computers to catch up with you.
Your best option at this point may be to go to a community college and get good grades there so you can transfer to a four-year college.

nope. you can wait a few years until you're a mature student with work experience and then try again. but for now you're outta luck
Nope. It will follow you until death. When I applied for a Masters the guy got my entire university history at a number of schools dating back 25 years online in a couple of minutes.
